1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern your access to and use of MyOtium (myotium.org), a retirement-planning tool operated by MyOtium ("we", "us", "our"). By creating an account or using the service, you confirm that you have read, understood, and accepted these Terms in full. If you do not agree, you must not use the service.
These Terms incorporate our Disclaimer, which forms part of this agreement.
2. Service Description
MyOtium is an online calculator and planning tool that models Danish retirement income based on information you provide. All outputs are projections for illustrative purposes only and do not constitute financial, investment, tax, or legal advice. See Section 7 (Disclaimer of Warranties) and Section 8 (Limitation of Liability) for the full scope of exclusions.
3. Eligibility
You must be at least 18 years old to use MyOtium. By registering, you confirm that all information you provide is accurate and complete. The tool is primarily designed for individuals subject to Danish taxation; projections for users outside Denmark may be materially inaccurate.
4. User Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@myotium.org if you suspect unauthorised access. We may suspend or terminate accounts that breach these Terms.
5. Acceptable Use
You agree not to: (a) use the service for any unlawful purpose; (b) attempt to gain unauthorised access to other accounts or our systems; (c) introduce malware or harmful code; (d) scrape, copy, or systematically extract data; (e) misrepresent your identity; or (f) use the service in any way that could damage, disable, or impair it.
6. Data Protection and Privacy (UK & EU GDPR)
We are committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the UK Data Protection Act 2018 (for users in the United Kingdom), and the EU General Data Protection Regulation (EU GDPR) 2016/679 (for users in the European Economic Area), together "the Data Protection Laws".

We do not collect special-category data (e.g. health, ethnicity, political opinions) and do not conduct automated decision-making that produces legal or similarly significant effects.

6.4 Retention
Account and financial data is retained while your account remains active. On deletion request, personal data is erased within 30 days, subject to any statutory retention obligation. Security audit logs are retained for up to 12 months. Records evidencing Terms acceptance may be retained for the period of any applicable limitation of action.
6.5 Third-Party Processors
We do not sell or rent your data. We share data only with sub-processors under appropriate data processing agreements:

All data is stored within the European Economic Area (EEA). The EU has granted the UK an adequacy decision, meaning transfers between the UK and EEA do not require additional safeguards.
6.6 Your Rights
Under the Data Protection Laws you have the right to: access your data (Art. 15); rectification of inaccuracies (Art. 16); erasure ("right to be forgotten", Art. 17); restriction of processing (Art. 18); data portability (Art. 20); object to processing based on legitimate interests (Art. 21); and withdraw consent at any time where processing is consent-based. 6.7 Cookies
MyOtium uses only a strictly necessary session cookie to maintain your login state. No tracking, advertising, or analytics cookies are used. No consent banner is required for strictly necessary cookies under applicable e-privacy law.
7. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. We expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement.
We make no warranty that: (a) the service will be uninterrupted, timely, secure, or error-free; (b) any projections, estimates, or results will be accurate, complete, or reliable; (c) the service reflects current tax legislation or pension rules; or (d) any defects will be corrected.
All projections produced by the service are illustrative estimates only and must not be relied upon as financial, investment, tax, or legal advice. Always seek qualified professional advice before making any financial decision.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- We shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to: loss of profits; loss of savings or retirement income; missed investment opportunities; costs of obtaining substitute advice; or any other financial loss, however caused and under any theory of liability.
- Our total aggregate liability to you for any claim arising out of or in connection with these Terms or the service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) £50 / DKK 450. If the service is provided free of charge, our liability is limited to £50 / DKK 450.
- We shall not be liable for any reliance you place on projections, forecasts, or estimates produced by the service, including where such projections later prove inaccurate due to changes in legislation, market conditions, or errors in data you provided.
- We shall not be liable for any loss or damage caused by events beyond our reasonable control (force majeure), including acts of God, government actions, cyber-attacks, or internet failures.
Nothing in these Terms excludes or limits liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) any liability that cannot lawfully be excluded or limited under applicable consumer protection law.
9. Indemnification
You agree to indemnify, defend, and hold harmless MyOtium and its officers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the service in violation of these Terms; (b) your violation of any applicable law or third-party right; or (c) any data you submit to the service that infringes any third-party intellectual property or privacy right.
10. Intellectual Property
All software, design, content, algorithms, and documentation comprising MyOtium are the property of MyOtium or its licensors and are protected by intellectual property law. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent. Your personal data and the financial figures you enter remain yours.
11. Termination
We may suspend or terminate your access immediately, without notice, if you breach these Terms or if we are required to do so by law. You may close your account at any time by contacting us. On termination, your personal data will be deleted in accordance with Section 6.4. Sections 7, 8, 9, and 12 survive termination.
12. Governing Law and Jurisdiction
These Terms are governed by Danish law. Disputes shall be subject to the non-exclusive jurisdiction of the Danish courts, without prejudice to your rights as a consumer under mandatory EU consumer-protection law or, for UK users, mandatory UK consumer-protection law. UK users retain the right to bring proceedings in the courts of England and Wales, Scotland, or Northern Ireland.
13. Changes to These Terms
We may update these Terms from time to time. For material changes we will notify you by email at least 30 days before the changes take effect. Minor or clarificatory changes take effect immediately. Continued use after the effective date constitutes acceptance. If you do not agree, you may close your account before the effective date.
